We’re pleased to share another record-breaking week of Spanish timeshare court claims. M1 Legal achieved 11 positive outcomes, with a total awarded to clients of £218,582.
The key timeshare resort legal action Spain results are set out below.
First Court of Instance
- Diamond Resorts – Fuengirola First Court of Instance No. 2: the judge found a breach of the requirements under Spanish timeshare law 42/1998 and Law 04/2012, citing missing information about the accommodation and the contract duration. The ruling made the timeshare contract null and void in Spain. Amount awarded: £15,245.
- Anfi – San Bartolomé de Tirajana Court No. 3: the judge declared the agreement null and void under Spanish timeshare law 42/1998 due to the absence of contract duration information. Amount awarded: £27,399.
- Club La Costa – Fuengirola Court No. 5: the judge ruled the contract null and void for failing to meet the requirements of Law 42/1998 (no duration information). Amount awarded: £38,128.
- Marriott – Marbella First Court of Instance No. 3: the hearing concluded after the judge declared the contract null under Law 42/1998 requirements (no duration information). Amount awarded: £28,203.
Provincial Court
- Anfi – Provincial Court of Las Palmas de Gran Canaria No. 5: the judge overturned the first-instance decision. The initial view was that where Anfi had cancelled a contract due to non-payment of maintenance fees, there were no grounds for a claim; this was found to be incorrect, and the case was amended in our client’s favour. Amount awarded: £42,987.
Appeals
- Club La Costa (x2) – The Court of Appeal in Malaga upheld two first-instance judgments confirming the timeshare contract cancellation in Spain on the basis of Laws 42/1998 and 04/2012. Amounts awarded: £24,774 and £21,414.
There were also three further wins: one against Martex, RCI and SSB Marketing, plus two additional Anfi judgments.
Jurisdiction
This week also saw success in three further cases where the resort appealed in an attempt to have claims rejected on Spanish jurisdiction grounds. All three were against Diamond Resorts, valued at £35,139, and will now proceed to the next stage.
