We are pleased to share last week’s Spanish timeshare court victories. M1 Legal achieved 18 successful outcomes, with Spanish court timeshare compensation awards totalling £298,156.
The compensation awards and contract findings are set out below.
1st Court of Instance:
- Club La Costa World x 4 – In these cases, the judge ruled timeshare contract null and void in Spain under Law 04/2012 due to insufficient information about the accommodation and the contract duration. Amounts awarded: £13,852, £9,924, £9,885, £18,282
- Diamond Resorts x 2 – The judge again declared the agreements null and void under Law 04/2012 because key accommodation and duration details were not properly provided. Amounts awarded: £13,248, £13,234
- Marriott Vacation Club – The judge found Marriott Vacation Club contract null because the duration exceeded the legal limit of 50 years (in perpetuity) and the accommodation was not properly identified. Amount awarded: £10,456
- Marriott Vacation Club – The judge declared the contract null due to breach of the legal duration limitation. Amount awarded: £40,197
- Marriott Vacation Club – The judge noted that the contract contained sufficient accommodation information, but confirmed nullity due to the duration breach and a payment made within the timeshare cooling off period Spain law. Amount awarded: £56,604
- Anfi x 2 – The court ruled Anfi timeshare court victory Spain in both matters. One contract was declared null under Law 42/1998 (minimum duration requirements not disclosed) and the other under Law 04/2012 (minimum accommodation information requirements not disclosed). Amounts awarded: £17,807, £21,134
- Leisure Dimensions (Infiniti) – The judge declared the contract null and void under Law 42/1998 due to insufficient information about contract duration. Amount awarded: £10,849
Appeals:
- Anfi – The Court of Appeal upheld our first instance win, confirming the contract was null and void due to a lack of information about contract duration. Amount awarded: £18,242
- Club La Costa World – Club La Costa appealed the first instance judgment, but the appeal court again ruled in our favour, confirming Club La Costa contract nullity Spain. Amount awarded: £18,379
Jurisdiction Victories:
We can also confirm three jurisdiction victories this week, with a combined value of £70,220, all against Club La Costa World. The company argued the cases should not be heard in Spain; however, the judge ruled in all three matters that the Spanish courts have jurisdiction. Each claim will now move forward to the next stage, adding to these Spanish timeshare claims results.
