Last week, we achieved positive results in four substantive cases against Club La Costa. Taken together, these four Club La Costa court victories resulted in total compensation awarded of £55,440.
In each case, the court declared the relevant agreement null due to contract nullity. The contracts were found to be missing key information—in particular, clear details about the property the client was said to be purchasing and when it would be available for the client to use. Where essential terms are unclear or absent, the court may determine that the contract cannot stand.
As well as the compensation outcomes, our legal team also secured three further favourable jurisdiction judgments against CLC. The contractual entities named in these proceedings were CLC Paradise Trading, Continental Resorts and Sucursal.
These matters were heard in the Arona court and the Fuengirola court. The combined decisions strengthen the position in relation to Club La Costa contract nullity and clarify how the courts are assessing missing or unclear contractual terms in these cases.
