£30,870 Club La Costa victory as timeshare contract declared null and void

Last week, our most significant result was a court win against Club La Costa, with an award of £30,870. In this ruling, the judge declared the Club La Costa timeshare contract invalid (nullity) because the agreement did not include key information and, as a result, failed to meet the legal requirements. The court also confirmed that all previous contracts linked to the same matter were null, bringing added clarity for our client.

In a separate case concluded last week involving CLC Sucursal, our client was awarded £11,667. Taken together, these outcomes underline how contractual defects and missing mandatory details can lead to a finding of contract nullity, with the court treating the agreement as not legally valid.

Similar issues arose in other hearings last week. In a case against Diamonds, the contract was also deemed null and the court awarded £12,834. Likewise, in a case against Anfi Sales, the agreement was declared null and £11,694 was awarded. Each decision followed the same core principle: where a contract does not contain required information, it may not satisfy the legal standards needed for it to stand.

Alongside these awards, our legal team also secured five favourable jurisdiction judgments against CLC, heard at the Fuengirola and Arona courts. These jurisdiction decisions support progress in ongoing and future matters by confirming that the courts can hear the claims. The contractual names involved in these cases were CLC Sucursal and CLC Continental Resorts.
