Last week, our legal team achieved a successful result in a case against Explotacion Hotelera, Royal Park Albatros, heard in the High Court of Tenerife. The court awarded £19,353 in compensation, with legal costs also awarded.
In our most recent case against Club La Costa, the Court of Appeal rejected their jurisdiction argument. Club La Costa claimed the procedure should sit with the English courts, but this was not accepted under the relevant Spanish and European laws, which provide enhanced consumer protection. The court also confirmed Paradise Trading as the vendor (despite their position that they were not party to the contract). CLC further argued that the contract ran for 19 years rather than in perpetuity, but the court found the term was conditional on the sale of allocated property. Finally, the lack of clear determination of the object of the contract was upheld. In this matter, our client was awarded £11,056.
In another favourable judgment, a case against Leisure Dimensions & Albatros Ventas resulted in an award of £4,395 to one of our clients. In addition, our legal team secured three jurisdiction wins against Club La Costa Sucursal.
