This week, our experienced legal team achieved a strong set of court wins, with judges awarding a total of £112,592 to our clients.
Club La Costa were defeated in eight separate timeshare court cases. In each case, the Club La Costa timeshare contract was found not to include key accommodation information that should be set out in the agreement – for example, what the clients own and when they are entitled to use their timeshare. The court also found that the contract term exceeded 50 years, which is beyond the legal limit in Spain. On each claim, the judges ruled in our clients’ favour and awarded the full amount claimed, including costs.

- Club La Costa Continental & Paradise
Diamond Resorts also suffered a defeat. The Diamond Resorts timeshare contract was found to be missing similar accommodation and usage details to those identified in the Club La Costa cases.
Alongside these claims, our legal team also argued appeals in the Spanish courts. We won four separate cases against Club La Costa Sucursal, where they had asked for the matters not to be heard in Spain. The judge ruled in our favour, agreeing with the points we raised, meaning Club La Costa will have to face these cases under Spanish law.
