M1 Legal has started the New Year with another Spanish timeshare court victory, securing a strong result against Club La Costa Paradise Trading. The claim was heard in early January at the Court of First Instance in Arona. Our lawyers demonstrated that our clients’ Club La Costa timeshare contract was not compliant with Spanish law because it failed to include the required accommodation details within the agreement. As a result, the judge awarded our clients more than £11,000 in compensation.
This outcome underlines the importance of proper information being set out clearly in Spanish timeshare contracts. Where key accommodation information is missing, the contract may be treated as non-compliant under the relevant legal requirements in Spain—and that can provide a basis for a compensation claim. In this case, the court accepted our position and made an award in our clients’ favour.
We also secured a positive outcome in a separate appeal against Club La Costa PLC. The judge agreed with our legal team again and confirmed that, where the clients are based in the UK, they are entitled to choose which jurisdiction their claim will be heard in. This clarity is helpful for claimants considering the most appropriate venue for progressing their case.
