The latest Silverpoint timeshare court ruling was heard at the Arona Court of First Instance in Tenerife. In its decision, the court found that the Silverpoint contract failed to meet the minimum legal requirements around the accommodation and the rights being purchased. In particular, the agreement did not clearly set out key details such as what the clients actually owned and the specific periods when they were entitled to use the accommodation.
The court also concluded that the agreement went beyond the 50-year maximum term permitted, which was a further reason the contract could not stand. As a result, the judge ruled that the Silverpoint contract was null and void.
Following this finding, the court ordered Silverpoint Vacations to pay the client £13,332.
This outcome adds to the growing number of Silverpoint cases decided in favour of M1 Legal, and marks another win where a Silverpoint contract has been declared invalid by the court.
