The claim was heard at the Court of First Instance in San Bartolomé de Tirajana, Gran Canaria, where the dispute centred on whether the timeshare contract met the statutory minimum standards.
In this Anfi timeshare case, the court found that the contract did not properly set out the legal minimum requirements relating to the accommodation – a key element in determining whether a timeshare agreement is valid under the applicable rules.
As a result, the judge declared the Anfi contract null and void and ordered Anfi to pay the clients £26,384 in compensation.
This represents a substantial loss for Anfi in Gran Canaria and a strong outcome for M1 Legal in pursuing the claim through the Spanish courts.
