In June 2010, the clients originally bought RCI points in Florida. In July 2011, they travelled to Cala Pi in Majorca with Restotel and traded in their RCI points. They say they were put under significant pressure to buy again, and that the product was sold to them largely as an investment. They were told the payments they would receive back over time were guaranteed. That did not happen, and the clients came to believe they had been mis-sold.
Their claim was brought against the contractual party, Medhotel S.L. (part of the Ona Group), and the case was passed to M1 Legal, who issued a lawsuit in the Spanish courts. At the hearing, the court heard that the timeshare contract was in perpetuity (with no end date) and did not set out the minimum legal requirements relating to the accommodation.
The judge declared the contract null and void and ordered Restotel S.L. to pay £84,763.
