We’re on a roll – three wins in two days. In this latest Spanish court decision, an Anfi timeshare contract has been quashed after the judge found the agreement was in perpetuity (open-ended with no fixed end date). The court ordered Anfi to repay our client £23,414.23, plus interest calculated from the date the payments began.
This ruling means the contract is treated as cancelled and the consumer is put back in the position they should have been in, financially, to the extent ordered by the court. For anyone questioning whether an Anfi timeshare contract in perpetuity can be challenged, this is another clear example of a court taking issue with indefinite terms and awarding a substantial refund where appropriate.
