March 2022 was another record-breaking month for the timeshare lawyers at M1 Legal

The latest news from Timeshare Advice Centre and European Consumer Claims.

M1 Legal continued its success in taking on timeshare companies in March 2022 as the Malaga-based legal firm broke more compensation records for victims.

Justice for victims of timeshare

Many people find themselves in the unfortunate position of being stuck in a timeshare agreement they don’t want to be in. Laws were established in 1999 to provide protection to consumers to help prevent them from making important financial decisions that had huge repercussions while they were enjoying a holiday in Spain. Unfortunately, the laws were ignored by many bad players in the timeshare market.

In fact, it took a whole 17 years before the first timeshare resort was forced to pay out compensation to Tove Grimsbo in 2016. Gran Canaria based Anfi had illegally sold her a contract with a longevity of more than 50 years, and Tove Grimsbo was awarded €40,000 after taking the company to court.

It was a historic win for timeshare victims, and it opened the floodgates to many more claims. Until this point, the companies had used a wide range of tactics to delay and prevent lawsuits from taking place, but the Tove Grimsbo victory changed that.

Ever since, timeshare lawyers have been winning case after case as they take on Spanish timeshare companies to get justice for clients who were illegally sold timeshare deals.

M1 Legal (M1) soon emerged as leaders in the field, and the expert lawyers have gone on to achieve huge success for their clients over recent years.

M1 Legal: Helping victims of timeshare resorts

M1 Legal is a firm comprising of highly experienced lawyers who are focused on getting justice for timeshare victims. They work together with European Consumer Claims (ECC), which is the largest timeshare claims firm operating in Europe.

Over the years, many timeshare owners were mis-sold deals, and there could be hundreds of thousands of victims out there. They want to get justice, so they turn to the ECC, which determines which claims are the strongest. It then refers them to M1 Legal, which diligently fights on their behalf to get them justice.

Timeshare resorts often use frustration tactics to delay proceedings, but since 2016, M1 has challenged these tactics and defeated them. Now, with every successful case, the claims process speeds up.

M1 has already won a record number of victories in 2022 for its clients, and it expects this to continue over the coming months.

Fernando Sansegundo, head of M1 Legal, said: "We are less than 3 months into 2022 and we have already secured 105 separate victories for our clients," he confirms. "This represents a total compensation award amount of £1,680,082. It is the best start to a year we have had since our inception."

A record-breaking month: March 2022

"Right now, nearing the end of March 2022 we have already broken all previous monthly records," continues Sansegundo. "There have been 39 court victories since the first day of this month. With 3 business days remaining, the total compensation award number so far is an incredible £573,190.

"That is 39 people who are not only free of their timeshare contracts and annual fee obligations, but were also awarded a financial windfall at the same time."

There were some impressive victories during the month that deserve special mention. These include:

  • Lynne and Ken D, who were awarded £42,987 in their claim against Club Gran Anfi.
  • Mark Andrew S, who was awarded £21,526 from Diamond Resorts.
  • Michael W, who was awarded £38,128 from Club La Costa.

The largest victory went to Angela and Derek W, who were awarded £59,175 in compensation after making a claim against Marriot Vacation Club.

The initial goal of most clients is simply to get out of their commitments to paying an annual fee. The fact that they were also awarded significant compensation is an additional bonus.

"These are significant amounts of money," says Fernando. "It's enough to buy a luxury car, or even add an extension to a house. On average the compensation awards that our lawyers win for ECC/M1 clients is in excess of £20,000.

"Two clients who received their award money last week, an Ayrshire couple called Douglas and Linda, called me to tell me they are having the entire inside of their home remodelled. They were so happy speaking to me on the phone. It is calls like that which remind me how lucky I am to do this job."

The right time to claim

“The real hard work in timeshare claims has been done," explains Fernando.

"The timeshare company lawyers are running out of ways to delay the claims process. Timeshare sales operations broke the law, and modern judges are making them pay. "People due compensation who apply now face a much shorter wait than people who started their claims back in 2016. If you bought timeshare in Spain, on or after the 5th January 1999, then you may be entitled to financial recompense too."
