We are pleased to share our latest Spanish timeshare court victories. M1 Legal has secured TWENTY SIX successful awards with a combined value of £504,470. The largest single result in this update was an Onagrup timeshare court case, totalling £137,256.
Here is a clear breakdown of the substantive outcomes and the amounts awarded:
1st Court of Instance:
- Club La Costa x 2 – Fuengirola: the judge confirmed a Club La Costa contract nullity, with the timeshare contract declared null Spain due to missing property and/or contract duration details. Amounts awarded: £11,781 and £34,396.
- Club La Costa – the judge declared a Spanish court nullity timeshare contract for missing property and/or contract duration information, including related agreements and the finance contract. Amount awarded: £22,028 plus interest.
- Marriott x 6 – Marbella: Marriott timeshare contract null Spain, with nullity declared due to missing property and/or contract duration information. Amounts awarded: £10,640, £11,700, £12,593, £13,410, £22,969, and £26,796.
- RCI – Tenerife: the judge declared the contract null, fully upholding the ruling in respect of Majexo. Amount awarded: £13,690.
- Heritage Resorts x 2 – Marbella: the contracts were declared null due to missing property and contract duration information. Amounts awarded: £10,012 and £13,000.
- Anfi – Gran Canaria: Anfi timeshare contract nullity declared due to missing property information. Amount awarded: £26,961 plus interest.
- Onagrup – Barcelona: the client’s contract was declared null against Intergroup SLU (Barcelona court timeshare contract null). Amount awarded: £137,256.
- Onagrup – the judgment fully upheld Club Estela Dorada, with costs and interest. Amount awarded: £31,600.
- Restotel – Barcelona: the contract did not set out the minimum property requirements, resulting in a win against Restotel and Club Estela Dorada. Amount awarded: £17,970.
We also received a positive judgment for Vilagia Park.
Appeals:
- Anfi x 2 – Gran Canaria: the Court of Appeal confirmed nullity due to missing property information (Gran Canaria timeshare appeal win). Amounts awarded: £20,130 and £11,286.
- Infiniti – the Court of Appeal declared the decision null and void due to lack of purpose and the receipt of prohibited advances, confirming that the First Instance judgment remains in force. Amount awarded: £14,300.
We also received positive appeal outcomes against The Regency Club and Pearly Grey.
