We are pleased to share M1 Legal’s final Spanish court victories for 2023. In December alone, M1 Legal secured seven positive awards totalling £382,398. These results included two Marriott cases with awards of over £100,000 each.
Below is a breakdown of the substantive outcomes:
First Instance Court (1st Court of Instance):
- Onagrup x 2 – The judge declared the contracts null due to missing property information and/or contract duration information (Laws 42/1998 | 04/2012). Amounts awarded: £39,775, £16,154.
- Marriott – In Marbella, the judge declared the contract null due to missing contract duration information. Amount awarded: £12,583.
- Marriott – Also in Marbella, the judge declared the contract null due to missing property information (Law 42/1998). In addition, the defendant was ordered to pay the legal fees and costs of the proceedings. Amount awarded: £103,000.
We also received a positive award against Elite Fuerteventura, as well as another positive result against Marriott.
Appeals:
- Club La Costa x 2 – The Court of Appeal confirmed two First Instance judgments declaring the contracts null due to missing property information and/or contract duration information (Laws 42/1998 | 04/2012). Amounts awarded: £19,754, £11,994.
- Anfi – The Court of Appeal confirmed the First Instance judgment declaring the contract null due to missing property and contract duration information. Amount awarded: £22,370.
- Marriott – The Court of Appeal confirmed the First Instance judgment declaring the contract null due to missing property information. Amount awarded: £133,000.
- Royal Park Albatros – The Court of Appeal declared the contract null and void due to missing property information and/or contract duration information. The defendant was also ordered to pay the legal fees and costs of the proceedings. Amount awarded: £10,400.
We also received a positive appeal decision against Diamond Resorts.
All of the cases listed above will now move on to the next stage. A fantastic achievement for everyone involved.
