We are pleased to share our latest Spanish timeshare court victories. M1 Legal secured EIGHTEEN positive court awards with a combined value of £317,587. The largest individual result came from a Marriott case, where the court ordered payment of £66,955 to our client.
Below is a summary of the key outcomes from these recent Spanish timeshare rulings:
1st Court of Instance:
- Marriott x 4 - In Marbella, the judge declared all four contracts null due to missing information on the property and/or contract duration. (Laws 42/1998|04/2012). Awards - £16,437, £13,600, £11,675, £14,153.
- Marriott - In a further Marbella matter, the judge again declared the contract null due to a lack of property and contract duration information. In this case, the contract between the plaintiff and MVCI Holidays S.L. alongside MVCI Management S.L. resulted in the judge ordering Marriott to refund the contract price, less weeks used, at a rate of £769 per year up to the date of judgment, with interest. The judge also ordered Marriott to pay sums paid during the legal resolution period, plus legal interest from the date the claim was filed. Award - £66,955.
We also received a positive award against Elite Fuerteventura.
Appeals:
- Club La Costa x 4 - The Court of Appeal confirmed four First Instance judgments declaring the contracts null due to missing information on the property and/or contract duration. (Laws 42/1998|04/2012) Awards - £20,402, £19,110, £34,764, £27,780.
- Anfi x 3 - The Court of Appeal confirmed three First Instance judgments declaring the contracts null due to missing information on the property and/or contract duration. (Laws 42/1998|04/2012) Awards - £20,179, £11,571, £19,128.
We also received further positive decisions against Tasolan, Club La Costa and Anfi.
