We are pleased to share this week’s Spanish court victories. M1 Legal secured TWELVE positive awards with a combined value of £182,813. The highest award was confirmed in a CLC Paradise Trading court case, totalling £45,949.
Below is a breakdown of the substantive results:
1st Court of Instance:
- CLC Sucursal x 2 - In Fuengirola (Courts 4 and 5), the judge declared both CLC timeshare contracts null under Law 04/2012: one due to a lack of accommodation information, and the other due to the contract duration. Amounts awarded - £9,938, £39,572.
- CLC Paradise Trading - In Arona (Court 1), the judge declared the contract null and void under Law 42/1998 due to a lack of accommodation information. Amount awarded - £45,949.
We also received confirmation of positive judgments against Gestiland 2000 (Club Marino Tenerife), CLC Continental Resorts and Diamond Resorts.
Appeals:
- CLC Sucursal x 2 - In the Court of Appeal, Malaga, it was confirmed that the first-instance judgments in both cases remain in force, with the contracts declared null due to insufficient information about the accommodation and the contract duration (Law 04/2012). Amounts awarded - £15,807, £20,861.
- CLC Paradise Trading - In the Tenerife Court of Appeal, it was confirmed that the first-instance judgment remains in force, declaring the contract null due to insufficient information regarding the accommodation and the contract duration (Law 04/2012). Amount awarded - £15,975.
We also received confirmation of further positive appeal outcomes against CLC Sucursal, plus another against MacDonald Resorts.
In ten of this week’s twelve cases, court costs were also awarded.
