We are pleased to share this week’s Spanish court results. M1 Legal secured six positive awards with a combined value of £103,976.
Below is a breakdown of the key outcomes:
First Instance Court
- Marriott (3 cases) – In Marbella Courts of First Instance Nos. 6 and 8, the judge declared all three Marriott timeshare contracts null under Law 42/1998 due to a lack of information about the contract duration. Amounts awarded: £12,064, £34,364 and £15,481.
Appeals
- CLC Continental – In the Court of Appeal No. 4 (Jaén), the appeal judgment upheld the first-instance decision declaring the contract null for failing to provide information on the contract duration. We also secured court costs. Amount awarded: £23,283.
- Anfi – In Las Palmas Court No. 3, the appeal judgment also confirmed the first-instance ruling that declared the contract null due to insufficient information regarding the contract duration. Amount awarded: £11,723.
Jurisdiction decisions
Seven positive results valued at £156,590
This week we were notified of seven positive jurisdiction outcomes: three against CLC Paradise Trading, one against CLC Continental Resorts, one against CLC UK PLC, and two against Diamond Resorts. In all seven cases, the defence argued that the claim(s) should not be heard in Spain; however, the judge ruled that the cases can be heard in Spain and will now proceed to the next stage.
