We’re pleased to share this week’s Spanish court victories. M1 Legal secured 8 positive results, with a total amount awarded of £77,134.
The awards are detailed below:
1st Court of Instance outcomes
- Diamond Resorts – The judge declared the contract null and void under the Law 04/2012 requirements, due to a lack of information about the accommodation. Amount awarded: £16,796.
- Anfi – The judge also declared the contract null and void under the Law 04/2012 requirements, due to missing accommodation information. Amount awarded: £22,790.
We also achieved 6 further wins. Two were first-instance decisions against Anfi and Wayfair. The remaining four were appeal victories: three against Anfi and one against Tasolan. Total amount awarded: £37,548.
Jurisdiction rulings in Spain
7 jurisdiction victories valued at £228,976.58
This week, we recorded six jurisdiction wins involving Club La Costa (with a claim value of £209,174) and one involving McDonalds Resorts (£19,802). In each case, the defence argued the claims should not be heard in Spain; however, the judge ruled that they can. In the six Club La Costa matters, the judge stated that the Mercantile Court in Spain is the appropriate court to hear the cases. The McDonalds Resorts decision was an appeal, and M1 Legal succeeded there too. All seven cases will now progress.
