Marriott, CLC, Diamond and Anfi all lose in Spanish timeshare court victories (£95,265)

We are pleased to share this week’s Spanish court victories. M1 Legal secured 7 positive results, with a total of £95,265 awarded.

Key awards and outcomes are set out below.

First Court of Instance rulings

  • Marriott – The judge declared the contract null and void under the requirements of Law 42/1998, due to missing information about the accommodation and the contract duration. Amount awarded: £10,164.
  • Club La Costa – The judge also declared the contract null and void under the requirements of Law 04/2012, due to missing information about the accommodation and the contract duration. Amount awarded: £25,227.
  • Diamond Resorts (2 cases) – In both cases, the judge declared the contracts null under the requirements of Law 42/1998. The contracts did not state the minimum accommodation information or the contract period. Amounts awarded: £17,400 and £21,526.

Appeal ruling

  • Anfi – At first instance, the judge initially upheld the cancellation due to non-payment of maintenance fees, meaning the outcome went in Anfi’s favour. However, on appeal, the judge confirmed the contract was null under the requirements of Law 04/2012, as no end date was disclosed. Amount awarded: £12,181.
