We are pleased to share last week’s Spanish court wins. M1 Legal secured 6 positive results, with a total amount awarded of £122,509. The awards are outlined below.
First Instance Court judgments:
- Club La Costa World – The judge accepted the previous contracts alongside the current contract and confirmed that all contracts were null. Certificates submitted by Club La Costa were treated as evidence linking the contracts to one another. The case was upheld due to missing accommodation information. Amount awarded – £15,295.
- Club La Costa World – A similar outcome, with the contract declared null based on insufficient information about the period. Amount awarded – £22,457.
- Club La Costa World – A further First Instance decision in our client’s favour, with the contract declared null due to missing information on contract duration and accommodation under Law 04/2012 requirements. Amount awarded – £11,268.
- Restotel (Medhotel) – The company was judged in default, and the result was very positive: the judge declared the contract null under Law 04/2012. The contract did not meet the minimum accommodation information requirements. Amount awarded – £26,761.
Appeal Court decisions:
- Anfi – The Court of Appeal confirmed our First Instance win, declaring the contract null and void due to missing information about the contract duration. Amount awarded – £21,440.
- Club La Costa World – The Appeal Court upheld the judgment in our favour, confirming the contract was declared null due to lack of information regarding the contract duration. Amount awarded – £25,285.
Jurisdiction victories:
We can also confirm 2 jurisdiction victories this week with a total value of £23,732 (one involving Diamond Resorts and one involving Club La Costa World). The resorts argued that the cases should not be heard in Spain; however, the judge ruled in both matters that the Spanish courts have jurisdiction, and both cases will proceed.
