We are pleased to share last week’s Spanish court victories. M1 Legal secured 8 positive results, with total awards of £83,787.
1st Court of Instance:
- Club La Costa Sucursal – The contract was declared null due to missing legally required information on contract length and accommodation details under Spanish law 04/2012. £20,689 awarded.
- Anfi – The contract was declared null due to missing legally required information on contract length and accommodation details under Spanish law 42/1998. Court costs were awarded in our favour. £19,108 awarded.
- Fuerteventura Life – The contract was declared null due to missing information on contract duration under Spanish laws 42/1998 and 04/2012. Court costs were awarded in our favour. £10,249 awarded.
We also received 3 further positive judgements against CLC Paradise Trading, Anfi and Marriott.
Appeals:
- CLC Sucursal – Great news: we won an appeal before the Málaga appeal court. The judge had previously awarded only £5,000 despite clients having paid £35,000. After appealing, judgment was granted in our favour. M1 Legal will use this judgment in new cases to help ensure earlier contracts shown in the price sheet are properly taken into account. £35,131 awarded.
- CLC Sucursal – The Court of Appeal confirmed our first-instance victory. Court costs were awarded in our favour. £23,739 awarded.
