We are pleased to share last week’s results from the Spanish courts. M1 Legal secured five successful outcomes, with a combined total of £45,151 awarded. There are fewer decisions to report than usual because the courts were closed for the pre-Christmas bank holidays on 6 and 8 December, which reduced the number of hearings and judgments.
Of the wins recorded this week, two were appeal decisions involving Club La Costa (CLC) Paradise. In both matters, the Court of Appeal confirmed the original first-instance rulings, meaning the Club La Costa timeshare contract was declared null and the earlier judgment stood.
Appeals: Club La Costa (CLC Paradise) contract nullity confirmed
- CLC Paradise – The Court of Appeal upheld our first-instance win, confirming Club La Costa contract nullity and awarding legal costs. £11,327 awarded.
- CLC Paradise – In a separate appeal, the Court of Appeal again upheld our first-instance win, confirming the Club La Costa contract declared null and awarding legal costs. £14,921 awarded.
In practical terms, an upheld appeal provides stronger certainty: the appellate court has reviewed the case and agreed that the original decision should remain in place. These outcomes reinforce the point that, where the court finds a timeshare agreement invalid, the Club La Costa timeshare contract can be treated as void and costs may also be recoverable.
Alongside these two Club La Costa appeal wins, we also achieved three further positive results against Anfi, Diamond Resorts and Marriott Vacation Club, contributing to the overall £45,151 total awarded across the five cases.
