We are pleased to share an update on last week’s positive Spanish court results. M1 Legal achieved 7 results, with a total of £162,902 awarded. A summary of the outcomes is set out below.
1st Court of Instance results
- Club La Costa Sucursal – The court declared the contract null due to missing information on contract duration and accommodation details, as required under Spanish law 04/2012. Court costs were awarded. £43,718 awarded.
- Silverpoint – The claim was brought against Silverpoint and Resort Properties. An out-of-court agreement was reached with Silverpoint’s administration, resulting in a positive outcome. Court costs were awarded. £46,254 awarded.
- Anfi – The court declared the contract null due to missing accommodation details, as required under Spanish law 04/2012. Court costs were awarded. £20,179 awarded.
- Club La Costa Sucursal – The court declared the contract null due to missing information on contract duration and accommodation details, as required under Spanish law 04/2012. £23,773 awarded.
- Club La Costa Sucursal – The court declared the contract null due to missing information on contract duration and accommodation details, as required under Spanish law 04/2012. £13,111 awarded.
We also received another positive initial result against Club La Costa, as well as a further outcome following an appeal submitted by Anfi, which was decided in favour of our clients.
Jurisdiction hearings
5 jurisdiction victories valued at £88,170
M1 Legal secured 5 jurisdiction victories last week: 4 against Club La Costa and 1 against Diamond Resorts. In each case, the defence challenged whether the matter should be heard in the Spanish courts. All cases will now proceed to the next stage.
