Four wins against Club la Costa: Spanish timeshare court victories and contract nullity rulings

We are pleased to share last week’s Spanish court victories. M1 Legal secured five positive outcomes, with a total of £69,879 awarded.

First Instance Court results

  • CLC Sucursal (x3) – In these three cases, the court declared the contracts null and void due to missing information about the contract duration. Two of the contracts were also annulled for a lack of property information. £48,480 awarded across the three cases.
  • CLC Sucursal – This is a final judgment from the judge in the 5th court in Fuengirola. The court granted the claim as requested, confirming the nullity of the main contract (£15,067) and ordering CLC to pay Barclays Partner Finance the loan amount of £44,193. The judgment states that CLC acted as a credit intermediary and that both agreements are linked. £15,067 awarded to our client.

There was also a positive judgment against Silverpoint.

Jurisdiction hearings (Club la Costa)

Two jurisdiction victories, valued at £41,616

M1 Legal secured two jurisdiction hearing victories last week, both against Club La Costa. The defence argued that the cases should not be heard under Spanish jurisdiction; however, the court rejected the challenge. Both cases will now proceed to the next stage.
