More Anfi and Club la Costa contracts declared null in Spanish court wins

Latest Recent Victories update from Timeshare Advice Centre.

We are pleased to share last week’s Spanish court wins. M1 Legal secured five positive results, with a total of £39,302 awarded.

First Instance Court rulings

  • Anfi – The court declared the contract null and void due to a lack of required information (period and object), as set out under Law 42/98. £12,100 awarded.
  • CLC Sucursal – The court declared the current contract null and void due to missing information about the accommodation. Although there was a previous contract, the judge did not find grounds to declare it null. £11,560 awarded.
  • CLC Sucursal – The court found the contract null and void due to insufficient information, specifically the absence of a defined contract object (accommodation). £9,717 awarded.

There were also two further positive judgements against Anfi, including one case where Anfi’s appeal was dismissed.

Jurisdiction hearings

Two jurisdiction victories valued at £55,788

M1 Legal also secured two jurisdiction decisions last week, both against Club La Costa. In each case, the defence challenged whether the claims should be heard in the Spanish courts. Both challenges were unsuccessful, and the cases will now proceed to the next stage.
