We are pleased to share an update on last week’s Spanish court victories, including successful outcomes involving Club La Costa and Albatros Ventas.
Across five results, M1 Legal achieved a total amount awarded of £90,908.
First Court of Instance (Spain)
These matters were heard at First Court of Instance level, where the court considered the validity of the timeshare contracts and the information provided to consumers at the point of sale.
- Club La Costa Sucursal – We had three cases heard against Club La Costa. In each, the court determined the nullity of the contract due to a lack of essential information, including details of the property and when it could be used. Total awarded: £45,526.
- Albatros Ventas – The court confirmed the nullity of the contract and also upheld the award of interest accrued during the 14-day cooling-off period. £24,729 awarded.
Appeal Court result
This result relates to a Club La Costa appeal following an earlier judgment at First Court of Instance.
- Club La Costa Continental – The Court of Appeal dismissed CLC’s appeal in full, upholding the original judgment from the First Court of Instance. The court also ordered CLC to pay court costs. £20,650 awarded.
