Marriott, Diamond and Anfi: first Spanish timeshare court victories since reopening (£47,544)

With the Spanish courts now re-open, we’re pleased to share our latest Spanish timeshare court victories.

M1 Legal secured three results, with a total of £47,544 awarded.

1st Court of Instance:

  • Diamond Resorts – The court declared the contracts null due to a lack of key information (including the property and when it could be used). Total amount awarded: £17,000.
  • Marriott Vacation Club – The court declared the contracts null due to a lack of key information (including the property and when it could be used). Total amount awarded: £15,875.
  • Anfi – The court declared the contracts null due to a lack of key information (including the property and when it could be used). Total amount awarded: £14,669.

8 Spanish jurisdiction victories valued at £135,091

M1 Legal also secured eight jurisdiction victories last week, all against CLC (a combination of CLC Sucursal and Paradise Trading). In each case, the defence challenged whether the claims should be heard in the Spanish courts. Three victories were at the initial jurisdiction hearing, and five were wins on appeal. All cases will now proceed to the next stage.
