CLC, Diamond, Onagroup and Fuerteventura Life: Spanish timeshare court victories worth £212,782

Latest Recent Victories update from Timeshare Advice Centre.

We are pleased to share last week’s Spanish court victories. The legal team at M1 Legal secured 12 awards totalling £212,782.

Six awards were made against Club La Costa, totalling £91,770. In each case, the court declared contract nullity due to a lack of key contractual information, including the property and when the client could use it. An additional award was secured against Onagroup (Resotel & Medhotel) on the same basis, with £34,330 awarded to the client.

Diamond Resorts also lost a case that went in our favour. The contract was found to lack essential information (including the property and when it could be used), and £20,238 was awarded.

Appeals

The Court of Appeal ruled in our favour against Fuerteventura Life, rejecting all points raised. They were also ordered to pay court costs. £9,200 was awarded. We also secured three further appeal wins against CLC, with CLC ordered to pay court costs in each case. The total value of these three cases is £57,240.

Jurisdiction

M1 Legal also secured four jurisdiction victories last week, valued at £45,696. Two were against CLC and two against Diamond Resorts. The defence challenged the cases being heard in the Spanish courts. Three wins were at the initial jurisdiction hearing, and one was a successful appeal. All jurisdiction cases will now proceed to the next stage.
