Last week, the legal team secured one award at the Court of First Instance and four successful appeal decisions, all in favour of M1 Legal.
Onagroup
The Barcelona Provincial Court has now ruled in a complex case against Perblau 2000 and Clubotel La Dorada, fully confirming the first-instance judgment in which the claim we filed was upheld in full. The contract had been issued by a company based in the British Virgin Islands (BVI), and our lawyer carried out extensive research to demonstrate that the BVI company did not exist. In this case, the courts considered all documents submitted at both first instance and on appeal. The information obtained enabled M1 Legal to present strong arguments regarding the defendants’ passive legitimacy. A significant result in this Onagroup-related case, with £10,321 awarded.
Appeals
At the Court of Appeal last week, M1 Legal reported successful decisions involving CLC Paradise Trading, Anfi Sales SL, Diamond Resorts and Anfi Sales & Resorts. In all four instances, the decisions mean these cases will now move forward to the next stage.
Jurisdiction
Across 15 jurisdiction hearings last week, the defence argued that the claims should not be heard in Spain. The judge ruled in all 15 cases that the Spanish courts do have jurisdiction to hear them.
