We are pleased to share last week’s Spanish court victories.
Our legal team secured four substantive results, with a total of £68,496 awarded. These cases included:
Anfi Tauro & Anfi Sales: The Court of Appeal in Las Palmas ruled in our favour, dismissed all elements of Anfi’s defence and ordered them to pay costs. £15,684 was awarded. We also achieved another victory against Anfi this week.
Club La Costa (CLC) – CLC Continental Resorts: The court declared the contract null due to a lack of key information, including the property details and when the client could use it. In this case, the judge acquitted Hitachi (the loan). The client is already listed on CLC’s creditors list. £26,905 awarded.
Club La Costa (CLC) – CLC UK PLC Sucursal España: The contract was declared null for the same reason: insufficient information about the property and when it could be used. £19,540 awarded.
In addition to these substantive results, the legal team also obtained 18 jurisdiction victories valued at £320,826. All of these were against CLC, apart from one against Diamond Resorts. The defence challenged whether the cases should be heard in Spain. Twelve victories were at the initial jurisdiction hearing, and six were successful appeals. All cases will now proceed to the next stage.
