We are pleased to share last week’s substantive Spanish court victories, where the legal team secured five successful outcomes with a total of £86,642 awarded. Below is a clear breakdown of the results.
Case 1 – CLC UK PLC Sucursal España: The contract was declared null due to missing key information (the property and when the client could use it). The client is already included on CLC’s creditors list. £12,982 awarded.
Case 2 – CLC UK PLC Sucursal España: The contract was declared null due to missing key information (the property and when the client could use it). The client is already included on CLC’s creditors list. £14,856 awarded.
Case 3 – CLC Continental (Court of Appeal): The Court of Appeal ruled in our favour and dismissed all elements of CLC’s defence. CLC was ordered to pay costs, and the client is already being presented in CLC’s liquidation proceedings. £23,717 awarded.
Case 4 – CLC UK PLC Sucursal España (final CLC case): The contract was declared null due to missing key information (the property and when the client could use it). £23,061 awarded.
Case 5 – Airtours Beach Club (Anfipan): The contract was declared null due to missing key information (the property and when the client could use it). Interest will also be applied from the date the contract began (over 20 years). £13,137 awarded.
In addition, there were 13 jurisdiction victories with a combined value of £253,111, all against CLC. In these cases, the defence challenged whether the claims should be heard in the Spanish courts. One result was at the initial jurisdiction hearing and 12 were successful on appeal. All cases will now move forward to the next stage.
