We are pleased to share last week’s Spanish court victories.
Our legal team secured eight substantive wins, with a total amount awarded of £185,361. Below is a breakdown of the outcomes:
Club La Costa: the court declared the contract null due to missing information, including details of the accommodation and when it could be used. £11,360 awarded.
Anfi (Gran Canaria Court of Appeal): the Court of Appeal dismissed Anfi’s appeal, upheld the first-instance judgment in our favour and ordered Anfi to pay costs. £31,703 awarded.
Continental Resorts: one of our longest-running cases. The judgment confirms contract nullity and recognises double the amount for payments made within the first three months. Early in the case, the Court of Appeal upheld a jurisdiction challenge, so we applied for the proceedings to be declared null, which our legal team secured. This decision will be important for future cases. £55,000 awarded.
Silverpoint: the contract was declared null due to missing information about the accommodation, when it could be used and the contract term. The client is already included on the creditors’ list in Silverpoint’s liquidation. £44,758 awarded.
Anfi (second case): the judge declared one contract null but not the other, so an appeal is likely to seek the best possible outcome. £16,600 awarded.
Club La Costa (CLC UK PLC Sucursal): the contract was declared null due to missing information about the accommodation and when it could be used. £15,807 awarded.
Anfi (two further cases): the final two awards this week against Anfi totalled £10,132.
In addition to these substantive victories, we also obtained eight jurisdiction wins valued at £168,526. Seven were against CLC and one against Diamond Resorts. In each case, the defence challenged whether the claim could be heard in Spain. Six were first-instance jurisdiction decisions, and two were successful appeals. All eight cases will now proceed to the next stage.
