We are pleased to share last week’s Spanish timeshare court victories.
Our legal team secured 12 positive results, with total awards of £238,651.
10 cases were against CLC (contractual names: Sucursal, Paradise & Continental). In each case, the court found the timeshare contract null and void due to insufficient information about the property, when it could be used, and the contract term. Total awarded: £199,815.
The next case was against Diamond Resorts. The court also declared the contract null and void because it did not clearly set out the property details, usage rights and the contract period. Awarded: £15,015.
The final case was against Anfi Sales & Resorts. The Court of Appeal confirmed the first-instance judgment declaring the contract null and void on all points, and ordered Anfi to pay the legal costs. Awarded: £16,616.
4 jurisdiction decisions were also positive, valued at £75,627.
Last week there were four jurisdiction victories against CLC: one initial win and three wins on appeal. All four cases will now move on to the next step.
