We are pleased to share last week’s Spanish timeshare court victories.
Our legal team secured three successful outcomes, with total awards of £86,184. Below is a summary of these substantive cases.
Explotacion Hotelera (Royal Park Albatros) – Although we lost at first instance, we went on to win at the Tenerife Court of Appeal. £39,127 awarded.
Marriott Vacation Club International – In this case, the Malaga Court of Appeal confirmed the contract’s nullity despite strong arguments from Marriott. The contract end date was 2077, which was unlawful, so the court ruled the agreement null and void. £33,992 awarded.
CLC Sucursal – The court found the contract to be null due to insufficient information about the accommodation, how and when it could be used, and the contract term. We also recovered our costs. £13,065 awarded.
Two positive jurisdiction results valued at £38,920
We also secured two jurisdiction wins against CLC Sucursal, including one decision upheld on appeal. Both cases will now proceed to the next stage in due course.
