Quadruple victory against Club La Costa: Spanish court declares CLC contracts null

We are pleased to share last week’s Spanish court victories.

Our legal team secured five substantive results, with a total awarded of £65,930.

Four of these victories were against Club La Costa, under the contractual names CLC Paradise and CLC Sucursal. In each case, the court declared the timeshare contract null due to insufficient information about the property, the clients’ usage rights and the contract term. Costs were awarded in all four cases, bringing the combined total awarded to £56,472.

The remaining award was for clients who owned at Royal Park Albatos, with £9,458 awarded.

We also achieved 11 positive jurisdiction decisions, valued at £268,100.

Last week, there were five initial jurisdiction victories against CLC (across a mix of Sucursal, Paradise and Continental), with a further six wins on appeal against earlier jurisdiction decisions. The defence argued that the claims should not be heard in Spain; however, the judge ruled that they can proceed.

All cases will continue in due course.
