We had a busy week in court, with a number of hearings completed.
Our biggest wins were in Club La Costa timeshare cases, brought against the following contractual entities:
- Club La Costa Paradise Trading
- Club La Costa Sucursal España
The cases were heard at Arona nº 5 and Fuengirola nº 5 Courts in mainland Spain. In total, we secured £70,396.17 in awards for our clients. All three clients were awarded in full, including costs. The court found that the timeshare agreements lacked key accommodation details, such as what could be used at which resort and when.
We also handled several jurisdiction matters involving CLC Paradise Trading and Sucursal España. We won all six, as the court confirmed that the plaintiffs are customers located in the United Kingdom, meaning they can choose where to bring the claim. In addition, there were three further jurisdiction cases in which we were successful against Diamond Resorts, under the contractual name Diamond Resorts Europe Limited Sucursal En España.
Other wins last week were against the following defendants:
- Diamond Resorts
- Tasolán
- Anfi Sales SL & Anfi Resorts SL
These cases totalled almost £40,000 in awards.
