Spanish timeshare court victories: 4 ANFI contracts ruled null and void, £57,698 awarded

Latest Recent Victories update from Timeshare Advice Centre.

This week we secured victories in four separate cases against Anfi sales. The hearings took place at San Bartolomé de Tirajana Courts Nos. 3, 1 and 5 in Gran Canaria.

The contracts our clients were given at the point of purchase were found to be unlawful because the terms exceeded the legal time limit and the paperwork was missing key accommodation information. This included which specific resort the timeshare related to and when the clients could use it. These points formed the basis of the San Bartolomé de Tirajana Anfi court case.

In each matter, the judge found in our clients’ favour and the total amount awarded across the four cases came to £57,698.18, an ANFI timeshare refund awarded to our clients.

Our legal team also won a case against Sunset Beach this week, heard at Torremolinos Court No. 2 in mainland Spain. Our client was awarded a total of £6,158, including costs. We brought the claim because the contract provided was missing legally required accommodation details, such as dates and locations.

Club La Costa also lost a further jurisdiction case against our legal team. In Fuengirola Court No. 5, the judge agreed that the consumer can sue in the location of their choice, allowing the Spanish courts to rule on the matter.
