Our legal team secured two court wins against Silverpoint Vacations in the past week.
Silverpoint is a timeshare group with resorts in the Canary Islands, Spain. This week we represented two sets of clients in claims heard at the Arona court in Tenerife. In both cases, the Silverpoint timeshare contracts were found to be unlawful. The judge highlighted that the contracts did not clearly set out key accommodation details, including what exactly the clients owned and the specific periods when they could use their units.
We’re pleased to report that, in both cases, our clients were awarded compensation totalling £32,928. They are understandably relieved to be free from their timeshare commitments.
Alongside these Silverpoint results, we also achieved further outcomes in court this week, winning seven jurisdiction cases against Club La Costa.
The contractual names included:
- Club La Costa Sucursal
- Club La Costa Paradise Trading
In these matters, Club La Costa argued that the cases should not be heard in the Spanish courts under the terms of their contracts. The judge accepted our position that the claims should proceed under Spanish law. As the clients are based in the United Kingdom, they can choose where to bring their claim, and the court rejected Club La Costa’s request. The legal processes will therefore continue through the Spanish courts.
Club La Costa has several resorts across the Costa del Sol in mainland Spain and in Tenerife, Canary Islands. The appeals were heard in a number of courts, including Fuengirola 5, Fuengirola 3 and Fuengirola 2 (mainland Spain) and Arona 5 (Tenerife).
