Last week brought another strong run of jurisdiction decisions in Spain in timeshare claims involving Club La Costa and Diamond Resorts. Below are the contractual entities where M1 Legal again had jurisdiction ruled in the client’s favour.
- Club La Costa UK PLC EP
- Club La Costa UK PLC Sucursal en España
- Continental Resorts Services SL
In total, there were nine jurisdiction victories against associated Club La Costa companies.
M1 Legal also secured a jurisdiction victory in a case involving Diamond Resorts, under the contractual name Diamond Resorts Europe Ltd Sucursal en España.
In each case, the defence argued that the claim should not be heard in Spain. The court has decided that these cases can proceed in Spain.
All matters are continuing and are currently awaiting a hearing date.
