Nine jurisdiction victories against Club La Costa upheld by Malaga court of appeal in Spain

M1 Legal are pleased to report nine Spanish jurisdiction victories in cases involving Club La Costa.

Following an initial decision that the claims did not fall within Spanish jurisdiction, M1 Legal appealed and the Málaga Court of Appeal overturned that ruling. The defence argued that the cases should not be heard in Spain on the basis that the contract was governed by English law. However, the appeal judge ruled in all nine cases that they can be heard in Spain.

The judge also noted that the UK address shown in the contracts is not a location where any company activity is carried out. As a result, the Spanish address applies, supporting that the lawsuits are valid for Spanish jurisdiction.

The contractual names used across the agreements vary and include:

  • Club la Costa UK PLC
  • Club la Costa UK PLC Sucursal en España
  • Paradise Trading S.L.

All cases will now be re-submitted for judgment.
