Another three Court of Appeal victories on Spanish jurisdiction in timeshare cases

Latest Recent Victories update from Timeshare Advice Centre.

M1 Legal have reported three more jurisdiction victories this week, taking the total to 18 cases this year on the same issue.

In each of the three matters, the court initially found that the claim did not fall under Spanish jurisdiction. M1 Legal appealed, and the Court of Appeal overturned that decision. The defence argued that the claims should not be heard in Spain because the contracts were governed by English law. That argument was rejected, and the cases have now been re-submitted to the Spanish courts.

The contractual names are:

  1. Diamond resorts Europe en España / Sunterra Tenerife Sales / Diamond Resorts Tenerife Sales SL.
  2. Paradise Trading SLU / Club La Costa Resorts & Hotels
  3. Club La Costa UK Sucursal en España.
