The clients originally purchased their timeshare from Sunterra Mijas sales S.L (now Diamond Resorts Excursion S.L.). They explained that, despite being sold high-quality accommodation during peak season, they repeatedly struggled to book as promised and were instead offered low-season availability. When they did secure bookings and arrived at the accommodation, they found the standard was significantly lower than expected. The contract also failed to set out the minimum legal requirements.
Having considered the evidence, the court found the Diamond Resorts contract null and void because it did not disclose those minimum legal requirements. The judge ordered Diamond to pay £17,597 plus interest.
