M1 Legal are pleased to confirm two further jurisdiction appeal victories against Club La Costa, with both cases confirmed as matters that should be heard by the Spanish courts.
In each appeal, the judge considered the contract jurisdiction question and ruled that the contractual parties – Club La Costa (UK) Sucursal en Espana and CLC (Paradise Trading SL) – are Spanish entities for the purposes of the claims. As a result, the court determined that the appropriate jurisdiction is Spain, meaning these Club La Costa contract disputes should proceed through the Spanish court system rather than elsewhere.
Following the rulings, the cases are now being re-submitted and fast-tracked to the lower courts in Spain so they can move forward on the correct procedural footing. This provides clear direction on where the claims should be dealt with and removes a significant early barrier in progressing the litigation.
These two outcomes bring the total to seven jurisdiction wins in matters relating to Club La Costa.
